Description and Consent to Participate

The hearts@work Heart Health Assessment (HHA) has been developed to help you better understand your heart health status. The Heart Health Assessment is a screening tool to be used in conjunction with the hearts@work program, and in consultation with a health professional.  

The information and recommendations contained in this Heart Health Assessment are based on the most current Canadian guidelines for heart disease and diabetes.  The Heart Health Assessment is for screening and educational purposes only and is in no way meant to replace a physician’s advice, diagnosis, and/or treatment.  The summary results you receive are not a health diagnosis, but a screening of your heart health, to help you identify your risk factors for developing heart disease and/or diabetes.   Reliance on any information provided by Healthy Heart Society of British Columbia in the Healthy Heart Assessment is solely at your own risk.

You may be referred to a physician for follow up and/or treatment and that it is your sole responsibility to pursue this follow up and/or treatment.  Healthy Heart Society of British Columbia reminds you to seek the advice of a physician or other qualified health provider with any questions you may have regarding a medical condition. Never disregard professional medical advice or delay in seeking it because of something you have read in the Heart Health Assessment.

The health and other personal information you provide on this site is confidential.  The only people authorized to have access to your personal information are the project staff at Healthy Heart Society of British Columbia, your health professional or health program representative who enables you to access the site and their staff, and CoreHealth Technologies Inc. technical support staff.   Persons authorized to have access to your personal information are required to sign a confidentially agreement prior to accessing any data.  Your data will be held in strict accordance with current privacy laws, and at no time will your data be released to a third party without your prior written consent or as otherwise permitted herein.  Any publication using information collected from this site will not reveal the identity of any participant.

Healthy Heart Society of British Columbia will not sell, rent, swap or authorize any third party to use your e-mail address without your permission.  This also applies to any information that personally identifies you.

Listed below are some of the security procedures that Healthy Heart Society of British Columbia and CoreHealth Technologies Inc. use to protect your privacy:

  • Uses firewalls to protect information held in our servers.
  • Utilizes Secure Socket Layer (SSL) encryption in transmitting information to our servers.  In order to take advantage of encryption technology, you must have an Internet browser which supports 128-bit encryption.
  • Closely monitors the limited number of Healthy Heart Society of British Columbia employees who have potential access to your information.
  • Requires all Healthy Heart Society of British Columbia employees to abide by our privacy policy.
  • Backs up our systems to protect the integrity of your information.

Despite Healthy Heart Society of British Columbia 's efforts to protect your information, there is always some risk that an unauthorized third party may find a way around our security systems or that transmissions of your information over the Internet may be intercepted.

When using the Healthy Heart Assessment, information will be transmitted over a medium that may be beyond the control and jurisdiction of Healthy Heart Society of British Columbia and its suppliers. Accordingly, Healthy Heart Society of British Columbia assumes no liability for or relating to the delay, failure, interruption, or corruption of any data or other information transmitted in connection with use of the Healthy Heart Assessment.

In no event shall Healthy Heart Society of British Columbia , its employees, agents and partners , or any third parties mentioned in this Description and Consent to Participate be liable for any damages (including, without limitation, incidental and consequential damages, personal injury/wrongful death, lost profits, or damages resulting from lost data or business interruption) resulting from the use of or inability to use the Healthy Heart Assessment, whether based on warranty, contract, tort, or any other legal theory, and whether or not Healthy Heart Society of British Columbia , its employees, agents and partners , or any third parties mentioned in this Description and Consent to Participate are advised of the possibility of such damages. Healthy Heart Society of British Columbia , its employees, agents and partners , or any third parties mentioned in this Description and Consent to Participate shall be liable only to the extent of actual damages incurred by you, not to exceed CDN $1000. Healthy Heart Society of British Columbia , its employees, agents and partners , or any third parties mentioned in this Description and Consent to Participate are not liable for any personal injury, including death, caused by your use or misuse of the Healthy Heart Assessment.  Any claims arising in connection with your use of the Healthy Heart Asessment must be brought within one (1) year of the date of the event giving rise to such action occurred.  Remedies under this Description and Consent to Participate are exclusive and are limited to those expressly provided for in this Description and Consent to Participate .

Information entered into the Heart Health Assessment may be used for quality assurance, program evaluation, research purposes, and/or counseling by Healthy Heart Society of British Columbia and/or its hearts@work coordinators. 

Healthy Heart Society of British Columbia may combine, in a non-identifiable format, the information entered into the Heart Health Assessment with information from other users to create aggregate date that may be disclosed to third parties for research, statistical, or analytical purposes. 

Your participation in the hearts@work program and your use of the Heart Health Assessment is entirely voluntary and you can refuse to participate or withdraw consent at any time without any consequences.

The information and recommendations contained in the Heart Health Assessment (the “Content”) is protected by copyright under both Canadian and foreign laws. Title to the Content remains with Healthy Heart Society of British Columbia or its licensors. Any use of the Content not expressly permitted by this Description and Consent to Participate is a breach of this Description and Consent to Participate and may violate copyright and other laws. All rights not expressly granted herein are reserved to Healthy Heart Society of British Columbia and its licensors.

If you violate any of this Description and Consent to Participate , your permission to use the Content automatically terminates and you must immediately destroy any copies you have made of any portion of the Content.

By accepting the Description and Consent to Participate, you also agree to the foregoing terms and agree that you have read, understand and will comply with this Description and Consent to Participate and the End User Agreement.

CoreHealth™ Technologies Inc. End User Agreement

This Agreement governs your use of CoreHealth™ Technologies Inc. ("CoreHealth") software (the "Software") and website (the "Website"). It exempts CoreHealth and other persons from liability or limits their liability, and contains other important provisions that you should read.

Each time you use the Software or the Website you signify your acceptance and agreement, without limitation or qualification, to be bound by this Agreement as it then reads, and you have the legal authority to agree to and accept this Agreement on behalf of yourself and any person you represent. If you do not agree with each provision of this Agreement, or you are not authorized to agree to and accept this Agreement on behalf of the person you purport to represent, you may not access or use the Website or the Software.

1. Ownership and Permitted Use of CoreHealth Products

The Website and the Software (including all content and other information in text, graphical, video and audio forms, images, icons, software, designs, applications, data, and other elements available on or through Website or the Software) is the property of CoreHealth and others, and is protected by Canadian and international copyright, trade-mark and other laws. Under the terms of this Agreement, CoreHealth grants you a non-exclusive license to use the Website and Software. CoreHealth may revoke your license at anytime in its sole discretion. Your use of Website and the Software does not transfer to you any ownership or other rights.

You may print Website pages provided that you do not modify any of the pages and you do not remove or alter any visible or non-visible identification, marks, notices, or disclaimers. The Website and its content may not be copied, framed, scraped, mirrored, data mined, imitated, reproduced, republished, uploaded, posted, transmitted, modified, indexed, catalogued, mirrored or distributed in any way, in whole or in part, without the express prior written consent of CoreHealth. You may not sell or resell any part of Website or the Software or access to Website or the Software, without the express prior written consent of CoreHealth.

2. Trade-mark Information

CoreHealth Technologies Inc., CoreCommunity, CoreAssist, CoreXL, CoreAssessment and CoreCoach are trade-marks and trade names owned or licensed by CoreHealth.

Other names and logos appearing on or in connection with the Website or the Software may be registered or unregistered trade-marks, service marks, trade names and logos of their respective owners.

Any use of the trade-marks, service marks, trade names or logos displayed on or in connection with the Website or the Software is strictly prohibited, and nothing appearing on or in connection with the Website or the Software will be construed as granting, by implication, estoppel, or otherwise, any licence or right to use any of those marks.

3. Disclaimers, Liability Exclusions/Limitations and Indemnity

Disclaimers

Your access to and use of the Software and the Website is at your own risk. The Software and the Website are provided on an "as is" and "as available" basis, without any representations, warranties or conditions of any kind, whether express or implied, and including without limitation implied representations, warranties or conditions of or relating to accuracy, accessibility, availability, completeness, durability, errors, fitness for a particular purpose, lack of negligence, merchantability, non-infringement, performance, privacy, quality, results, security, sequence, service, timeliness, title, uninterrupted service, viruses or workmanlike effort, all of which are hereby waived by you and disclaimed by CoreHealth to the fullest extent permitted by law. There will not be any representations, warranties or conditions created by a course of dealing, course of performance or trade usage.

Without limiting the generality of the foregoing, CoreHealth is not responsible for any health or medical conditions arising from or attributable to your use of the Website and Software. CoreHealth provides generalized information only. Specialized advice can only be provided by your health care professionals. You are strongly advised to consult a physician before commencing any exercise or fitness program.

Liability Exclusions

Without limiting the generality of the foregoing and notwithstanding any other provision of this agreement, under no circumstances will CoreHealth ever be liable to you or any other person for any indirect, incidental, consequential, special, punitive or exemplary loss or damage arising from, connected with, or relating to your use of the Website or the Software, this Agreement, the subject matter of this Agreement, the termination of this Agreement or otherwise, including but not limited to personal injury, loss of data, business, markets, savings, income, profits, use, production, reputation or goodwill, anticipated or otherwise, or economic loss, under any theory of liability (whether in contract, tort, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongdoing (including without limitation gross negligence and fundamental breach) by CoreHealth or any person for whom CoreHealth is responsible, and even if CoreHealth has been advised of the possibility of such loss or damage being incurred.

Liability Limitation

Without limiting the generality of the foregoing and notwithstanding any other provision of this agreement, under no circumstances will the total aggregate liability of CoreHealth to you or any other person under any theory of liability (whether in contract, tort, strict liability or any other theory or law or equity), regardless of any negligence or other fault or wrongdoing (including without limitation gross negligence and fundamental breach) by CoreHealth or any person for whom CoreHealth is responsible, and even if CoreHealth has been advised of the possibility of such potential loss or damage being incurred, ever exceed TEN DOLLARS $10 (CDN). You hereby release, remise and forever discharge CoreHealth from any and all liability in excess of TEN DOLLARS $10 (CDN).

Indemnity

You will indemnify, defend and hold CoreHealth harmless from and against any and all liabilities, expenses and costs, including without limitation reasonable legal fees and expenses, incurred by CoreHealth in connection with any claim, demand or proceeding arising out of, related to, or connected with your access to or use of the Website or the Software, your Breach of this agreement, or any wrongful conduct by you or any person for whom you are responsible under this Agreement or at law. You will assist and co-operate as fully as reasonably required by CoreHealth in the defence of any such claim, demand or proceeding.

Acknowledgement

You acknowledge and agree that this Agreement represents a fair allocation of risk and liability. Advice and information provided by CoreHealth, whether oral or written, will not create any representation, warranty, condition or guarantee or vary or amend this Agreement (including this Section), and you may not rely upon any such advice or information.

4. Governing Law and Dispute Resolution

This Agreement, your access to and use of the Website and the Software, and all related matters are governed solely by the laws of British Columbia, Canada and applicable federal laws of Canada, excluding any rules of private international law or the conflict of laws that would lead to the application of any other laws. Any dispute between you and CoreHealth or any other person arising from, connected with or relating to the Website or the Software, this Agreement, or any related matters (collectively "Disputes") will be resolved before the Courts of British Columbia, and you hereby irrevocably submit and attorn to the original and exclusive jurisdiction of those courts in respect of all Disputes.

Any rights not expressly granted by this Agreement are reserved to CoreHealth.
